Applying for a temporary residence card in Vietnam for foreigners involves many different cases and target groups, along with various accompanying procedures. Here are some notes to keep in mind when applying for this procedure:
1. What is a temporary residence card in Vietnam?
Based on the regulations in Article 3, Clause 13 of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam No. 47/2014/QH13:
A temporary residence card is a document issued by the immigration management agency or the authorized agency of the Ministry of Foreign Affairs to allow foreigners with the right to reside in Vietnam for a certain period of time, and it has the same value as a visa.
Thus, we can understand that a temporary residence card is a type of document that simultaneously represents both residence and visa values. Foreigners using a temporary residence card can enter and exit Vietnam multiple times without needing to apply for a visa or travel permit during the validity period of the temporary residence card.
2. Some common types of temporary residence cards in Vietnam
- Temporary residence card for workers (LD), issued to foreign workers who are working in Vietnam under the sponsorship of organizations or businesses that have been granted labor licenses for a usual period of 2 years;
- Temporary residence card for investors (DT), issued to foreign investors in Vietnam, representatives of capital contributions of foreign companies in Vietnam, and foreign lawyers practicing in Vietnam. The duration of the investment card depends on the amount of the investor’s capital contribution;
- Temporary residence card for a family visit (TT), issued to foreign spouses, children under 18 years old of foreigners who have been granted temporary residence cards with the symbols LV1, LV2, DT, NN1, NN2, DH, PV1, LD, or to foreigners who are fathers, mothers, spouses, or children of Vietnamese citizens.
3. Conditions to note when issuing temporary residence cards in Vietnam
- The passport must have a validity period of at least 13 months from the date of submission of the temporary residence card application;
- A work permit or exemption from a work permit must have a validity period of at least 1 year. If the validity period is less than 1 year, only an LD visa can be issued;
- Documents proving that the applicant is a shareholder or a contributor to the enterprise, such as investment certificates, capital transfer contracts, etc., must be notarized and accompanied by documents proving the amount of investment;
- Documents proving family relationships, such as marriage certificates, birth certificates, household registration books, and identity cards of the individual guaranteeing the certified translation or legally notarized copies.
4. Documents to prepare when applying for a temporary residence card in Vietnam
- Application for a temporary residence card for labor purposes (LD) requires:
- Original passport + temporary residence card (if any)
- Work permit, notarized copy of work permit exemption
- Copy of temporary residence confirmation
- 2×3 photos (02 photos)
- Request letter for temporary residence card according to form NA6
- Declaration requesting a temporary residence card for foreigners according to form NA8
- Legal documents of the enterprise.
- Application for a temporary residence card for investment purposes (DT) requires:
- Original passport + temporary residence card (if any)
- Notarized certificate of investment, capital transfer contract, etc.
- Copy of temporary residence confirmation
- 2×3 photos (02 photos)
- Request letter for temporary residence card according to form NA6
- Declaration requesting a temporary residence card for foreigners according to form NA8
- Legal documents of the enterprise.
Application for a temporary residence card for visiting relatives purposes (TT) requires:
- Original passport + temporary residence card (if any)
- Form NA7 requesting confirmation from the local police of the foreigner’s place of residence
- Notarized Vietnamese translations of marriage certificates, birth certificates, and household registration books
- Household registration book + notarized copy of the identity card of the guarantor. If the guarantor is a foreigner, a valid temporary residence card must also be submitted
